PRETORIA, Sudáfrica (AP) — Oscar Pistorius quedó libre bajo fianza mientras espera por su juicio por matar a tiros a su novia Reeva Steenkamp el Día de San Valentín, decidió el viernes un magistrado.
Después de cuatro días de audiencias, el magistrado Desmond Nair deliberó durante casi dos horas antes de anunciar su decisión de conceder la fianza al famoso atleta con las piernas amputadas.
Nair impuso una fianza de 1 millón de rands (113.000 dólares), de los que Pistorius tendrá que pagar 11.300 dólares y demostrar que el resto del dinero está disponible. El magistrado indicó que el velocista olímpico y paralímpico tiene que entrar sus pasaportes y cualquier arma de fuego que posea.
Pistorius no puede salir del distrito de Pretoria, la capital de Sudáfrica, sin el permiso de su oficial supervisor, ni ingerir alcohol o drogas, indicó el magistrado. Tampoco puede regresar a su lujosa casa en un suburbio de Pretoria, donde ocurrió la muerte de Steenkamp.
La próxima audiencia judicial es el 4 de junio. Pistorius abandonó el tribunal en una camioneta Land Rover plateada, sentado en el asiento trasero, una hora después que le magistrado impuso las condiciones de la fianza.
"Todos estamos satisfechos porque Oscar recibió fianza hoy, pero al mismo tiempo seguimos de luto con la familia de Reeva por su muerte", comentó el tío de Pistorius, Arnold Pistorius. "Como familia, creemos en la versión de Oscar sobre lo que pasó esa noche trágica, y sabemos que esa es la verdad y que prevalecerá en el juicio".
El abogado de Pistorius, Barry Roux, dijo a los reporteros que la defensa está satisfecha con la fianza.
Nair tomó la decisión después de cuatro días de audiencias en los que se escucharon los alegatos de la defensa y la fiscalía. En la sesión del viernes en el tribunal de Pretoria, Pistorius por ratos lloró y también lució tranquilo, especialmente al final cuando el magistrado criticó el comportamiento de la policía en el caso, y ya era evidente que su fallo sería favorable al corredor.
Nair dijo que la declaración jurada de Pistorius, en la que ofrece su versión de los hechos sobre el tiroteo en la madrugada del 14 de febrero, lo ayudó en su solicitud de fianza.
"Llego a la conclusión que el acusado merece quedar libre bajo fianza", declaró.
Los familiares y seguidores de Pistorius gritaron "¡sí!" cuando el magistrado anunció su fallo.
Pistorius, el primer atleta con las piernas amputadas que compite en unos Juegos Olímpicos, dijo en una declaración jurada que le disparó accidentalmente a su novia —una modelo y participante en un reality show— porque creyó que era un ladrón escondido en el baño de su casa.
La fiscalía alega que el incidente ocurrió después de una discusión y que Pistorius tenía intención de matarla, por lo que lo acusó de asesinato premeditado.
Sharon Steenkamp, prima de Reeva, había dicho antes que la familia no estaría pendiente a la decisión de la fianza y que no ha estado siguiendo las incidencias en Pretoria.
"No cambia el hecho de que Reeva ya no está con nosotros", le comentó a la AP.
A pesar del fallo sobre la fianza, el vocero de la fiscalía, Medupe Simasiku, afirmó que "todavía confiamos en nuestro caso".
Pistorius encaró los requisitos de fianza más estrictos que contempla la ley sudafricana debido a la gravedad del cargo, y sus abogados tuvieron que demostrar que no abandonará el país, que no interferirá con los testigos y o el caso, y que su liberación no provocará manifestaciones.
Nair puso en duda que Pistorius vaya a huir y que se esconda por el mundo, cuando corre el riesgo de perder una fortuna en dinero, vehículos, propiedad y otros bienes. También dijo que aunque se demostró que Pistorius tiene tendencias agresivas, no cuenta con antecedentes penales.
El magistrado criticó a Hilton Botha, el detective que estaba a cargo del caso, por no hacer más para descubrir la evidencia de que el atleta tenía tendencias violentas.
"Hay mucho tiempo y libertad para hacer eso investigando los antecedentes del acusado", expresó.
Botha fue excluido del caso el jueves, cuando se supo que estaba acusado por intento de homicidio.
